Rental Terms and Conditions
RENTAL CHARGES AND PAYMENT You agree to return Equipment, insured, at your expense, to 0-360.com by "3 Day Service" or better. You will be charged for rental days for each day after the third for return transit time.
DEPOSIT RENTAL PAYMENTS APPLY TO PURCHASE PRICE. You have the option to purchase the Equipment. If you wish to purchase the rented Equipment, notify 0-360.com BEFORE shipping it back. In such event, 0-360.com will not charge the published rental fees, but will convert the rental to a purchase. You will be charged the published sales prices for the Equipment received, plus freight and taxes. Once the Equipment is returned to 0-360.com, you will be charged the applicable rental fees, and this option will expire.
YOUR RESPONSIBILITIES Upon return of damaged Equipment, 0-360.com will make a determination of the extent of the damage and the required repairs. In determining whether Equipment shall be replaced or repaired, 0-360.com's judgment shall be conclusive upon you. Should 0-360.com determine that the Equipment must be replaced, you will be responsible for the cost to replace the same item or the closest comparably equipped model, at current published retail prices less any discounts available, without deduction for depreciation, plus freight and taxes. If repaired, you shall be responsible for all repair costs, including freight and taxes. If, upon inspection, 0-360.com discovers blemishes, including but not limited to, fingerprints, stains or other marks on the glass components of the camera or Optic, you will be charged a $50 cleaning fee. Cleaning of other components, such as the camera's LCD screen or body will require a $25 fee. If the components are not able to be reasonably cleaned, or if cleaning the discovered blemishes reveals permanent damage, such as indelible scratches or marks to the components, you will be responsible for the replacement cost of the components. Upon notification of damages, you will have the option of purchasing the Equipment, in its AS-IS condition, at the cost to replace the same item or the closest comparably equipped model, at current published retail prices less any discounts available, without deduction for depreciation, plus freight and taxes. You are responsible for all costs (freight charges, taxes, duties, brokers fees, bonds, insurance and any other costs) incurred during transit and rental period. You are responsible for shipping and insurance charges for returning the Equipment to 0-360.com.
LOST, STOLEN OR DESTROYED EQUIPMENT.
YOU ASSUME ALL RISKS OF LOSS, DAMAGE, AND LIABILITY. AGREEMENT GOVERNED UNDER LAWS OF THE STATE OF NEVADA. This Agreement shall be governed by and construed under the laws of the State of Nevada. The parties shall attempt to resolve all disputes arising out of this agreement in good faith, in a spirit of cooperation without formal proceedings. In the event a dispute cannot be so resolved, and 0-360.com refers the enforcement of its rights under or relating to this Agreement, including the collection of any sums due 0-360.com, to its attorneys or other agents, you agree to reimburse it for all reasonable attorneys' fees and other costs incurred in connection therewith. In the event either party shall resort to the judicial system for enforcement of its rights hereunder, you agree that the state and federal courts located in Carson City County, Nevada, USA shall have exclusive jurisdiction of such claims and you hereby consent to the personal jurisdiction of such courts. Nothing herein contained shall in any manner prevent or preclude 0-360.com from bringing any one or more actions against you in any jurisdiction in the United States or elsewhere.
NO WARRANTY OR GUARANTY WHEN THE RENTER IS AN ENTITY, SUCH AS A CORPORATION, LIMITED LIABILITY COMPANY OR PARTNERSHIP. The person(s) executing the Rental Contract on behalf of such entity warrants that he/she has full authority of such entity to sign the Rental Contract and obligate the entity.
